Fisk Presents on Employee and Employer Rights
Attorney Erik Fisk presented "Leveling the Playing Field - Knowing Employee and Employer Rights When OSHA Wants to Interview an Employee" at the Iowa-Illinois Safety Council’s 65th Annual Professional Development Conference & Expo, April 11-13, at the Coralville Marriott in Coralville, Iowa.
As anyone who has ever experienced an OSHA inspection is well aware, a key element is the agency’s interviews of employees by the compliance officers from the U.S. Occupational Safety and Health Administration (OSHA) or State OSHA plans. It is generally recognized that the majority of OSHA citations are based upon OSHA interviews of management and hourly employees who admit violations. In addition, Managers and employees have admitted personal and corporate criminal liability during these interviews because they are unaware of their rights, including the right to decline to be interviewed. Unfortunately, a lot of confusion has occurred over the respective rights of OSHA, the employer and the employees. This session clearly described the rights of OSHA, the employer and employees and provided practical recommendations on how to participate in these interviews.
