Attorneys Present on Construction, Employment, and Business Topics at Seminar
Whitfield & Eddy Law attorneys Steve Marso, John Fatino and Jay Casini delivered presentations to attendees of the Gannon Roofing Supply Business Builder Seminar on February 15, 2017 at The Meadows Event Center in Altoona, Iowa.
Steve Marso spoke on the topic of “Fundamentals of Construction Contracts: Key Provisions in Subcontracts.” The topic covered important subcontract/purchase order provisions, such as incorporation-by-reference, flow-down, conditional-payment, claims-procedures, attorney-fee, and indemnity clauses, and addressed the issues of lien waivers and whether subcontractor bids to general contractors are binding and enforceable.
John Fatino discussed “Mechanic’s Liens in Iowa” including definitions, documentation, filing responsibilities with Iowa’s Secretary of State, and lien rights for commercial, residential and owner-builders.
Jay Casini presented on the topic: “Employee” or “Independent Contractors” – (Mis)classification And Consequences. Casini discussed Federal and Iowa law standards for classifying workers as either "employees" or "independent contractors," and how intentional and unintentional misclassification of workers can result in investigations and penalties by federal and state government entities as well as potential civil liability to workers who were not properly classified.
