Labor & Employment Law Update: DOL Publishes New Guidance on Overtime Pay for Commissioned Employees


The Department of Labor recently issued a new opinion letter that addresses the time period required to calculate retail and service workers’ pay. The Fair Labor Standards Act exempts certain employees from overtime pay requirements. Opinion Letter FLSA 2019-13 clarifies the number of pay periods retail and service industry employers must consider when calculating whether a commissioned employee is exempt from overtime pay.
