Construction Law Update: Homestead a Defense to Mechanic's Lien Claims

The Iowa Supreme Court has ruled on the much anticipated case of Standard Water. The Iowa Supreme Court of Iowa has held that Iowa’s homestead statute (Iowa Code Chapter 561) is a defense to attorney fee claims which arose under Chapter 572 (the mechanic’s lien statute) against the homestead. Standard Water Control Systems, Inc. v. Jones, No. 17-2009, Slip op. at 17, (February 7, 2020). However, interest and costs can be a lien against the homestead. Slip. op. at 19.
