The article describes the Iowa case law that would govern the foregoing scenario, which reflects the majority rule that a subcontractor’s mechanic’s lien rights would be limited to and/or must be apportioned by the labor, materials, and/or equipment the subcontractor furnished in relation to the remaining lots. This article also examines some outlier jurisdictions that do not follow the majority rule.
